Terms of Service

These Terms of Service ("Terms") govern your use of BurnWeek, including the BurnWeek mobile/web app and the BurnWeek app for ChatGPT (collectively, the "Service"), operated by Fit Labs OÜ ("BurnWeek", "we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What BurnWeek is
BurnWeek is an AI-assisted calorie and protein tracker. You describe what you eat in plain language; BurnWeek estimates nutrition as ranges and tracks your daily and 7-day totals. The Service is provided for general wellness and informational purposes only.
2. Not medical advice
BurnWeek is not a medical device or a healthcare service and does not provide medical advice, diagnosis, or treatment. Calorie and protein figures are estimates with inherent uncertainty (shown as ranges) and may be inaccurate. Do not rely on BurnWeek for medical, dietary, or clinical decisions. Consult a qualified professional for any health concern or before changing your diet.
3. Eligibility
You must be at least 13 years old to use the Service. The Service is not directed to children under 13.
4. Accounts and authentication
Sign-in is handled by our identity provider (WorkOS AuthKit) via Apple, Google, or an emailed one-time code. You are responsible for keeping access to your sign-in method secure and for activity under your account. You may connect your existing BurnWeek app data to ChatGPT using a one-time link code; only link accounts you control.
5. Acceptable use
You agree not to: misuse or attempt to disrupt the Service; access another user's data; reverse-engineer, scrape, or overload the Service; use it for any unlawful purpose; or submit content that violates the rights of others. When using BurnWeek inside ChatGPT, you are also bound by OpenAI's applicable terms.
6. Your content
You retain ownership of the food descriptions and data you submit ("Your Content"). You grant BurnWeek a limited license to process and store Your Content solely to provide the Service (estimate nutrition, store and display your logs and totals). We handle Your Content as described in the Privacy Policy.
7. Third-party services
The Service relies on OpenAI (ChatGPT and the estimation API), WorkOS, and AWS. Your use of ChatGPT is also subject to OpenAI's terms and privacy policy. We are not responsible for third-party services.
8. Fees
The BurnWeek ChatGPT app is provided free of charge. There are no in-app purchases, subscriptions, or digital goods sold through the Service.
9. Availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms; material changes will be indicated by updating the "Last updated" date. Continued use after changes means you accept them.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy of estimates, fitness for a particular purpose, and uninterrupted availability, to the maximum extent permitted by law.
11. Limitation of liability
To the maximum extent permitted by law, BurnWeek and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on calorie/protein estimates or your use of (or inability to use) the Service.
12. Termination
You may stop using the Service and delete your account at any time (see the Privacy Policy). We may suspend or terminate access for violations of these Terms.
13. Governing law
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules.
